  • Account Services: User authentication and account management

3. Account Registration

3.1 Account Creation

To access certain features, you may need to create an account. You may register using:

  • Email and password
  • Google OAuth authentication
  • Microsoft OAuth authentication

3.2 Account Responsibilities

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

3.3 Email Verification

You must verify your email address before submitting certain requests (e.g., life insurance quotes). OAuth users (Google/Microsoft) are automatically verified.

4. Use of Services

4.1 Permitted Use

You may use our Services for:

  • Requesting insurance quotes and information
  • Securely transferring documents related to insurance services
  • Communicating with our team
  • Managing your account and quote requests

4.2 Prohibited Use

You agree NOT to:

  • Upload malicious files, viruses, or malware
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to access the Services
  • Share your account credentials with others
  • Submit false or fraudulent information
  • Use the Services for any illegal purposes

5. Secure File Transfer

When using our Secure File Transfer service:

  • Storage: Files are uploaded to Microsoft SharePoint Online
  • Organization: Files are organized by group name (if provided)
  • Access: Only authorized Nester Insurance staff can access uploaded files
  • Retention: We retain files as necessary for business and legal purposes
  • Your Responsibility: Ensure files do not contain viruses or prohibited content

6. Insurance Services Disclaimer

Please note:

  • Quote requests are for informational purposes only
  • Final insurance terms are subject to underwriting approval
  • We work with multiple insurance carriers
  • Actual coverage and rates may differ from quoted amounts
  • Insurance products are subject to state regulations and availability

6A. Health Information and HIPAA Compliance

6A.1 Health Information Collection

When you request a life insurance quote, we collect health information including:

  • Medical history and current health conditions
  • Medications and treatments
  • Height, weight, and biometric data
  • Smoking status and lifestyle habits
  • Family medical history

6A.2 Use of Health Information

Your health information will be used to:

  • Process your life insurance quote request
  • Submit applications to insurance carriers

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Nester Insurance provides the Services "AS IS" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees paid by you (if any)
  • We are not responsible for third-party service failures or data breaches

11. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, including:

  • Fraudulent or illegal activity
  • Extended period of inactivity
  • At your request

Upon termination, your right to use the Services will immediately cease. We may retain your data as required by law or for legitimate business purposes.

12. Changes to Terms

  • Enhanced data security and breach notification (72 hours)

Pennsylvania

  • Licensed under PA Department of Insurance
  • Principal office: 313 West Ridge Pike, Limerick, PA 19468
  • Subject to Pennsylvania Insurance Code
  • Dispute resolution available through PA Insurance Department

New Jersey

  • Licensed under NJ Department of Banking and Insurance
  • Subject to NJ Insurance Code
  • Strict information privacy requirements under NJ Insurance Information Act
  • Consumer protections under NJ Consumer Fraud Act

Delaware
